1. Operator and acceptance
DOMALYST is an independent domain-intelligence service operated from Thailand by Phacharawat Bunpiphatkun, operating DOMALYST (the “Operator”). By creating an account or using the service after being shown these Terms, you agree to them. If you do not agree, do not use the account features.
2. What DOMALYST provides
DOMALYST provides domain analysis, watchlists, private portfolio tools, renewal-decision support and related intelligence. It does not require transfer of domain custody and is not currently a registrar, escrow provider, broker, marketplace or drop-catching service.
3. Evidence and uncertainty
Outputs may include ranges, confidence, evidence, unknowns, scenarios and suggested actions such as BUY, HOLD, REVIEW, DROP, PASS or DO NOTHING. A displayed output is not a promise that a domain can be bought or sold at a particular price or within a particular time. Missing evidence remains Unknown rather than being silently converted to zero.
4. Your decisions
You remain responsible for acquisition, renewal, pricing, trademark, tax, legal, financial and transaction decisions. DOMALYST is software for decision support and is not legal, tax, investment, brokerage or escrow advice.
5. Accounts and security
Provide accurate account information, keep credentials secure and use only accounts you are authorized to use. Do not share credentials in a way that creates unauthorized access. You may export your application data, clear your private workspace or permanently delete your account through the service.
6. Your data and permissions
You retain responsibility for data you submit. You grant DOMALYST a limited permission to host, process, analyze and display that data as necessary to operate features you request, secure the service and meet legal obligations. Private portfolio and buyer-intent information is private by default.
7. Optional aggregate contribution
If DOMALYST offers optional contribution to aggregate outcome or buyer-intent intelligence, participation must be explicit. Permission for aggregate use does not by itself authorize public disclosure of your identified raw portfolio, transaction or buyer-intent data.
8. Third-party data and services
Registration, DNS, marketplace, auction, listing, comparable-sale and other third-party data may be incomplete, delayed, revised or unavailable. Third-party services are subject to their own terms. DOMALYST does not control those third parties and does not guarantee their continued availability.
9. Acceptable use
Do not attack, overload, evade published limits, bypass access controls, probe other users' data, upload unlawful material, interfere with service operation, infringe third-party rights, or use DOMALYST to facilitate fraud or illegal transactions. Automated access must respect published limits and any future API terms.
10. Plans and billing
Billing is not active unless a checkout or paid plan is clearly presented. Before any charge can occur, DOMALYST will state the price, billing period, renewal behavior, taxes or fees known to us, cancellation method and any applicable refund terms. Nothing on a planning or informational page creates a payment obligation.
11. Availability and changes
We may change, suspend or limit features to maintain security, reliability, legal compliance or evidence quality. We will try to give reasonable notice of material changes when practical, especially where they materially reduce a paid service.
12. Intellectual property
DOMALYST software, branding, methodology presentation and original product materials are protected by applicable intellectual-property rights. These Terms do not transfer ownership of DOMALYST technology to users. You keep rights in content and data you lawfully submit.
13. Warranty disclaimer
To the maximum extent permitted by applicable law, DOMALYST is provided on an “as available” basis. We do not warrant uninterrupted operation, a specific valuation outcome, buyer interest, liquidity, investment return or transaction completion. This clause does not exclude warranties or rights that applicable law does not permit us to exclude.
14. Limitation of liability
To the maximum extent permitted by law, the Operator will not be liable for indirect, incidental, special or consequential loss, loss of opportunity, or loss caused by relying on incomplete third-party market data. For claims that may lawfully be limited, aggregate liability will not exceed the greater of the amount you paid DOMALYST during the 12 months before the event giving rise to the claim or US$100. This limit does not apply where liability cannot lawfully be limited, including fraud, willful misconduct, gross negligence, death or personal injury where applicable, or mandatory consumer rights.
15. Suspension and termination
We may suspend access for security incidents, abuse, unlawful activity or material breach of these Terms. You may stop using the service at any time and may permanently delete your account. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits and dispute terms, continue as permitted by law.
16. Governing law and disputes
These Terms are governed by the laws of Thailand, without overriding mandatory rights that apply to you under consumer, privacy or other non-waivable law. Before filing a claim, the parties should try in good faith for 30 days to resolve the dispute through the Contact page. If it is not resolved, disputes may be brought before the courts of Thailand, except where applicable mandatory law gives you the right to bring a claim elsewhere.
17. Changes to these Terms
Material changes will be dated and made available on this page. If a change materially affects an existing paid commitment or a right that requires separate consent, we will handle that change as required by applicable law rather than relying only on continued use.
18. Severability and entire agreement
If part of these Terms is unenforceable, the remaining provisions continue to the extent permitted by law. These Terms, the Privacy Notice and any clearly presented paid-plan terms form the agreement for the relevant DOMALYST service.
